1. Acceptance of Terms

• By accessing or using PromptBee, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
• These Terms govern your use of PromptBee's prompt refinement tools, development planning features, and related services.
• Your continued use constitutes acceptance of any updates to these Terms.
• PromptBee reserves the right to modify these Terms at any time, with notice of material changes.

2. Service Description

What PromptBee Offers

• Prompt Refinement: AI-powered tools to create, refine, and optimize prompts for large language models.
• Development Planning: Automated generation of comprehensive technical specifications and implementation plans for software projects.
• Prompt Library: Save, manage, organize, and share your prompts with the community.
• Free Access: PromptBee is currently a free service with usage limits for fair access.

3. User Eligibility and Accounts

Account Requirements

• You must be at least 13 years old to use PromptBee. Users under 18 require parental or guardian consent.
• Account creation is optional but provides higher usage limits and additional features.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information during registration.
• One account per person; multiple accounts may be terminated.
• You are responsible for all activities under your account, whether authorized or not.

4. Data Usage and Third-Party AI Providers

Important Information About Your Content

• Your Ownership: You retain all intellectual property rights to content you create or provide to PromptBee.
• License Grant: By using our services, you grant PromptBee and our AI providers a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
  • Process, analyze, and generate responses to your inputs
  • Use your content to train, improve, and develop AI models
  • Monitor content for abuse, safety, and quality purposes
  • Comply with legal obligations and enforce these Terms
• No Confidentiality: Do not submit confidential, proprietary, sensitive, or personally identifiable information through PromptBee.
• Commercial Use: You may use generated outputs for any lawful purpose, including commercial applications.

5. Usage Limits and Fair Use

Service Limits

• Unsigned Users: 5 free prompt refinements and 2 free development plans per browser.
• Authenticated Users: 200 prompt refinements and 50 development plans per month.
• Limits reset monthly for authenticated users.
• PromptBee reserves the right to modify usage limits at any time to ensure fair access for all users.
• Attempts to circumvent usage limits (e.g., creating multiple accounts) may result in service termination.

6. Prohibited Activities

Acceptable Use Policy

You agree NOT to use PromptBee to:

• Violate any applicable laws, regulations, or third-party rights.
• Generate, promote, or distribute illegal, harmful, abusive, hateful, harassing, threatening, or discriminatory content.
• Create content that promotes violence, terrorism, self-harm, exploitation of minors, or illegal activities.
• Spread misinformation, disinformation, spam, or engage in fraudulent activities.
• Impersonate any person, organization, or entity.
• Attempt to circumvent security measures, rate limits, or usage restrictions.
• Reverse engineer, decompile, or extract underlying AI models or proprietary systems.
• Use automated systems (bots, scrapers) to access the service without permission.
• Provide professional advice (legal, medical, financial) without appropriate qualifications and oversight.
• Interfere with or disrupt the service or servers.

Violations may result in immediate account suspension or termination and may be reported to authorities where appropriate.

7. Service Availability and Modifications

• PromptBee is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee uninterrupted, error-free, or secure service.
• We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.
• We may impose additional limitations on certain features or services at our discretion.

8. Limitation of Liability

• PromptBee and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• This includes damages for loss of profits, data, goodwill, or other intangible losses.
• You use PromptBee at your own risk and are solely responsible for how you use generated content.
• AI-generated content may contain errors, inaccuracies, or inappropriate material. Verify all outputs before use.

9. Indemnification

You agree to indemnify and hold harmless PromptBee, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use or misuse of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or generate through PromptBee

10. Termination

• You may stop using PromptBee at any time by deleting your account.
• PromptBee may suspend or terminate your access immediately, without notice, for violations of these Terms.
• Upon termination, your right to use the service ceases immediately.
• Provisions that should survive termination (including data usage licenses, liability limitations, and indemnification) will continue to apply.

11. Governing Law and Disputes

• These Terms are governed by the laws of Canada and the Province of Ontario.
• Any disputes shall be resolved in the courts of Ontario, Canada.
• You agree to waive any right to a jury trial or to participate in a class action.
